Would you pay him, or not??? Your opinion please?

I just moved into a hous, and when i first arrived a distant cousin of mine cam over to help me get settled in. There was a shack in my backyard that was old and falling apart. He carged me $450 to tear it down. I didn't pay him all the money up front. He took the wood and the tin that it was made of and sold it. He also left the shingles from the roof, and a huge pile of wood that could not be sold all over the yard. He never returned to clean it up so my son and i had to. Over the course of two months of not coming to clean up the mess, he broke his hip, everything else that he had fixed for me is now broken , and he was paid in full for those jobs.I haven't finished paying him for the shacks yet.


1 my toilet which is leaking and we cant use it


2 My roof which is still leaking, more than it was


3my kitchen sink which the pipe fell out of


4 installed my hood for my oven which i cant turn off


Not to mention i still have to pay someone else to haul away the stuff .

Would you pay him, or not??? Your opinion please?

Reply:I wouldn't pay him. Depending on the terms of the agreement, it appears that he did not make a complete performance. The fact that he has broken his hip is of no consequence. He still didn't keep up his end of the bargain. If he wants, let him sue you for the rest of the money.
Reply:I don't think I would pay him for it, if he didn't finish the job, why should you finish paying him for it. Like you said you have to pay someone else for the job to be done, I would tell your cousin, that you will not be paying him for the job because he did not finish it, and you are having to re-do everything he did. I think he owes you the money back, not that he would pay it I'm sure, but still....
Reply:No more money you are done. Sorry he broke his hip. Continue doing everything you can to clean up the mess and call a pro and ask for a work guarantee. Check home improvement sites and dyi (Do it Yourself) sites, now that you own the place these issues will continue to come up. Be really polite when he calls and don't talk bad about him. If he takes you to court provide proof of shoddy work. Let it go. Don't let it spoil your new home. With a broken hip he is not coming back soon if at all. And you know what for those problems you cannot wait for him to correct them they need to be fixed now.

silly rifts between relatives/friends. You were wise not to pay


him up front--but always, always put things in writing! Sounds like he made such a mess you'd never want him back, also,


that he wasn't qualified to do the work at all. The one thing you


got out of this was a lesson!

Reply:this is a tough one, only because he is your cousin. you may want to pay him, but only if you arent willing to have a family argument over this. if he was someone you had just hired there is no way you would pay him and you would even probably take him to small claims court. if you are willing to hear some crap about this from the rest of your family, then dont pay him. personally, i wouldnt pay him and i wouldnt care what my relatives had to say. also if i was your relative i would take your side. it depends on how much of a hassle you are willing to have over this.
Reply:I couldn't help but view some of your questions you have asked ,pay the bill.
Reply:If you pay undeserving people, you will be promoting inefficiency and lack of responsibility. I don't think you should let him get away with such an attitude. Help him become more responsible in his future jobs by letting him know that this kind of behaviour is not appreciated anywhere. At times one has to be ruthless to teach a difficult lesson. Think about it. Have a nice day!
