i have seen regular, permanent employees going for leave more than 1 year even, without pay though.

will his job remain secure ? where he can come back and join after 6 months.

Reply:this depends on the terms of the contract. review these terms and see if there is a clause either allowing or disallowing long leaves. If you are unsure than consult an attorney.

Reply:Whether or not a contractual employee proceed on six months leave directly depends upon the contract of employment. If the contract provides for it he can otherwise he canno. Contract signed by both the parties will be binding in this matter.
If there is no specific contract, the Conduct rules of the company provides for it. If there are no conduct rules, the relevant conduct rules act applicable to that industry will be made applicable.
On the face of it such long leaves are not entertained generally and a contract employee doesn't have any lein on the job when once he proceeds on illegal leave for which he is not entitled. Consult a services lawyer locally for further clarification and help.
Reply:Usually Govt institutes wont allow any contractual employee to avail long leave more than 15 days. Most contracts have strict conditions and you have to go through such agreement signed. If you are very particular ask for a copy of your contract as per right to information act and you will get acknowledgement immediately for your request. But it is better to resign the job in case you are sure you will get another job. Otherwise dont go for legal actions. You have little scope for winning the game finally.
